What is it about?
The EPO’s Boards of Appeal are the final judicial authority at the EPO. Their case law shapes the daily practice of the EPO in examination and opposition. The webinar will look at major decisions of the Boards of Appeal that have been handed down over the last months and discuss their impact on the EPO’s practice. A particular highlight this time is that the session will focus around three decisions of the Enlarged Board of Appeal (EBA) – all issued within the last four months. - G 1/24 (“Heated Aerosol”) – the groundbreaking decision on claim construction and how the Technical Boards of Appeal and the Examining Divisions have applied the findings of the EBA so far,
- G 1/23 (“Solar Cell”) – the EBA’s decision on the question whether non-reproducible characteristics of prior products can form part of the prior art against European patents and applications, and
- G 2/24 (“Skin Cleanser”) – the EBA’s decision on the rights of an intervenor during appeal proceedings and procedural implications for parties seeking to challenge the validity of a patent.
